Mixed student denied transfer because of race

This is a story that’s been making the rounds on various listservs. An Ohio mother is suing her school district for denying her son a transfer to a different school. The school claimed it couldn’t accept her biracial son because doing so would throw off the “racial balance” of their school.
Her request was rejected because Keith, whose mother is white and father is African-American, is considered a minority under a district policy that aims to maintain “racial balance” in its schools…
Tharp’s lawyer, Robert Newman, said the policy is unconstitutional because it is based solely on race, creating a quota system.
The U.S. Supreme Court recently upheld a policy that considered race in college admissions, but it rejected a policy that used a point system that made race a primary factor in admissions.
Newman said Northwest’s policies on transfers don’t pass constitutional muster because they appear to be based solely on race, rather than on other factors that could lead to a transfer request.

I see, so race-based quotas are only a problem when a White mom don’t get her way?
